4th Circuit refuses to stop admission of transgender people in the military starting Jan. 1

The Richmond, Virginia-based 4th U.S. Circuit Court of Appeals has refused the government’s request for a partial stay that would stop the admission of transgender recruits to the military starting Jan. 1.

The 4th Circuit is the first appeals court to rule on a government stay request in cases challenging the government’s ban on transgender people serving in the military, according to a press release from the American Civil Liberties Union. The case is Stone v. Trump. U.S. District Judge Marvin Garbis of Baltimore had issued a preliminary injunction blocking the government policy last month. Judges in Washington, D.C., and Seattle have also enjoined the transgender ban.

According to BuzzFeed, the 4th Circuit order “brings the question closer to the Supreme Court.”
