Boris Johnson can prorogue parliament, Scottish judge rules

A Scottish judge has rejected calls to block Boris Johnson’s decision to suspend parliament, in a blow to anti-Brexit campaigners.

Lord Doherty ruled the prime minister had the powers to ask the Queen to prorogue parliament despite claims during an emergency court hearing on Thursday that Johnson was acting illegally and in breach of the constitution.

Doherty’s decision, issued at the court of session in Edinburgh, is certain to be appealed by the group of 75 MPs and peers who brought the case.

The UK government also faces parallel legal actions by anti-Brexit campaigners in London and Belfast who are also attempting to block the suspension of parliament.
