Gibson Dunn partner says he would turn down a solicitor general nomination

Gibson, Dunn & Crutcher partner Miguel Estrada doesn’t intend to go through another bruising confirmation battle.

Estrada was said to be a top possible nominee for solicitor general, but Estrada told the National Law Journal (sub. req.) that he would turn down the nomination.

“I have only respect and best wishes for those who agree to serve despite the deterioration of the confirmation process over the years,” Estrada said, “but everyone who knows me in this town knows that I would never accept a job that requires Senate confirmation or, for that matter, willingly place myself in any situation (e.g., a hearing room) in which convention requires that I be civil to [U.S. Sen.] Chuck Schumer.”

Estrada was referring to a difficult confirmation hearing held when he was nominated for an appellate judgeship, the National Law Journal explains. After a filibuster by Senate Democrats, Estrada withdrew from consideration in 2003.
